Discuss How The Law Affects Development In Kenya (Essay Sample) Content: Development in most third world countries is hampered by corruption and immunity among the state officials. In Kenya, the legal framework has tried to provide for measures to curb corruption and foster development. These include coming up with an elaborate tax structure that is fair and the Vision 2030 goals which is an economic policy plan. Liberty and integrity has been lauded by economic and legal pundits as key in fostering development in Kenya. Among the legal measures taken to ensure that there is integrity among state officials is following the spirit and letter of Chapter Six of the Constitution.This chapter provides for the conduct of State officers which should conform with the national values espoused under article 10 of the Constitution. The public officials ought to also exercise the power in a manner that demonstrate respect for the people, brings honour to the nation and dignity of the office and promotes public confidence in the integrity of the office .[Constitution of Kenya, article 73(1)] Although Chapter Six has been operational and legislation enacted to realize the spirit and letter of the chapter, the integrity of public officials is still wanting. This negatively affects the proper environment needed to achieve development in the country. First and foremost, there should be political goodwill by the executive branch of the government to fight corruption and ensure that Chapter Six is fully implemented. The Legislature also has a monumental part to play to fully realize Chapter Six of the Constitution. This includes enacting legislation to fully implement chapter Six and providing severe punishment for those who are found guilty. With a secure and corruption-free environment in Kenya, investors will be confident in investing and public funds will be channeled to legitimate development projects.Administration means the people who are tasked with the implementation of government, government policies to ensure that development s in Kenya are undertaken. Administration bureaucracy on the other hand means the administrative procedures that are to be followed for the implementation of projects and making decisions.
